Italian automaker Ferrari has been hit with a $3.5 million NHTSA fine for failing to comply with NHTSA regulations regarding submitting quarterly early warning reports (EWR reports) to the National Highway Traffic Safety Administration. According to the NHTSA press release, Ferrari failed to submit EWR reports for three years and did not report three fatal accidents associated with its vehicles to the NHTSA as is required by law.
Hefty NHTSA Fine Isn’t the Only Penalty Ferrari Faces
Since 2000 when the Transportation Recall Enhancement, Accountability and Documentation (TREAD) Act became federal law, large manufacturers of vehicles (including their affiliates) are required to submit thorough EWR reports to the NHTSA on a quarterly basis. These reports are intended to point out any possible or existing safety issues with any of manufacturer’s vehicles.

Additionally, under TREAD, large manufacturers are required to report the following to the NHTSA on a quarterly basis:
- Production information
- Any vehicle-related incidents related to injuries or fatalities
- Aggregate data regarding damage claims, warranty claims and consumer complaints
- Copies of field reports regarding specific vehicle equipment, vehicles fires or vehicle rollovers.
Ferrari is considered to be a large manufacturer and failed to meet these obligations. In its failure to comply with federal law, Ferrari not only faces a $3.5 million NHTSA fine, but it also will be required to:
- Submit all missed EWR reports to the NHTSA
- Train its staff on NHTSA EWR reports
- Report all improvements to the NHTSA
As U.S. Transportation Secretary Anthony Foxx has stated, “There is no excuse for failing to follow laws created to keep drivers safe, and our aggressive enforcement action today underscores the point that all automakers will be held accountable if they fail to do their part in our mission to keep Americans safe on the road.”
