A 17-year-old male is currently facing vehicular homicide and vehicular assault charges for allegedly causing a fatal car accident that ended up killing two teens and leaving a third with serious injuries.

While the criminal case against this teenager will reportedly be resolved in the juvenile criminal justice system, there may be another case this this teen has to face – namely, a wrongful death case – in the civil court system if the families of the victims killed in this accident choose to move forward with civil cases against the negligent teen driver.

Details of the Fatal Car Accident

As the criminal case against a teen who allegedly caused a fatal car accident moves forward, a civil wrongful death lawsuit against the teen may be imminent.

As the criminal case against a teen who allegedly caused a fatal car accident moves forward, a civil wrongful death lawsuit against the teen may be imminent.

According to court documents and the police report associated with the case, the accused teen was reportedly driving his Mini Cooper at 80 mph in a 40-mph zone on Monday September 1. The accused teen – as well as the three other teenage passengers in his vehicle – were all allegedly intoxicated at the time of the accident.

As the vehicle was going more than double the speed limit, the driver blew through a stop sign at Hodgen and Roller Coaster roads in El Paso County and became airborne when the driver lost control of the vehicle. Investigators believe at this point that the Mini Cooper ended up becoming airborne three times before it ultimately collided with a fence and hit a row of trees at the bottom of a nearby embankment.

While two of the teen passengers sustained fatal injuries, the third passenger, who was severely injured, is still being treated for his injuries in the Penrose Hospital. He is reportedly in fair condition at his point.

Investigators with the Colorado State Patrol are still looking into who may have provided alcohol to these teenagers. If the adult responsible for supplying these teens with alcohol is ultimately identified, (s)he could also face criminal charges, as well as civil penalties in a wrongful death lawsuit.
